The petitioner is one of several accused persons in what is alleged to be a case of gruesome murder. Several persons were injured, one of whom died.

The petitioner says that he has no specific role to play in the alleged incident. He is in custody for about two years and 265 days. There is no likelihood of the trial concluding at an early date. He may be released on bail on such conditions as this court may decide.

From the case diary produced by the learned Advocate for the State, we find that prima facie there is sufficient incriminating material against this petitioner. There are statements of witnesses recorded under Section 164 Cr. P. C. implicating the petitioner. We have also seen the post mortem report. The victim was killed in a terrible manner.

On an overall assessment of the material on record and the gravity of the offence, we are not inclined to allow the petitioner's prayer for bail at this stage.

CRM (DB) 1581 of 2024 is, thus, dismissed.

However, considering that the petitioner has already been in incarceration for a long period of time, we direct the learned Trial Court to expedite the trial as much as possible and bring the same to its logical conclusion at the earliest.
