We have heard learned counsel for the parties. Keeping in mind the delay that the plaintiff has suffered but also keeping in mind the ends of justice, we pass the following order disposing of this application (CAN 2 of 2022).

The issues framed in 2014 shall be the issues in the suit with no further addition.

The applicant/defendant shall be permitted to produce one witness. Witness action is to be concluded or deemed to be concluded on 15th December, 2022. Arguments shall be concluded by 20th December, 2022.

All procedural directions in connection with this order shall be made by the learned judge in the court below.
