The petitioners pray for expeditious disposal of Misc. Appeal No.22 of 2017 pending before the learned Additional District Judge at Baruipur, South 24-Parganas. According to the petitioners, the appeal was filed sometime in 2017 against an order of temporary injunction. Thereafter several dates have been fixed for hearing of the misc. appeal, but no decision has yet been taken. Under such circumstances, considering the innocuous nature of the prayer of the petitioners and upon considering the petitioners are senior citizens, this Court is of the view that the misc. appeal should be disposed of within a period of three months from the next date fixed upon allowing all the parties

to contest the same. No unnecessary adjournments shall be granted.

No prior notice is required upon the opposite party as none stands to lose if the litigation is disposed of expeditiously.

This Court has not gone into the merits of the appeal and the learned court below shall continue with the proceedings independently.

The petitioners are directed to serve a copy of the revisional application along with a server copy of this order upon the opposite party within a week from date. Accordingly, the revisional application is disposed of. There will be, however, no order as to costs. The learned court below shall proceed on the basis of the service copy of this order.
