Mr. Anirban Dutta Mr. Abhra Jena ... for the Petitioner The petitioner challenges an order passed by the learned Additional Sessions Judge, 2nd Court, Sreerampore dated 05th June, 2026 in Criminal Revision No. 27 of 2026 thereby staying the operation of an order dated 15th May, 2026 passed by the learned Special Executive Magistrate, Sreerampore, on an application under Section 163(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
It appears that the learned Additional Sessions Judge in the Court below fixed the next date of hearing on 17th August, 2026. Keeping in the mind the nature of proceedings, this Court is of the view that the learned Additional Sessions Judge in the Court below should decide the revisional application expeditiously.
Since the expeditious hearing of the revisional application pending before the learned Additional Sessions Judge will not prejudice the opposite parties, this Court is
inclined to dispose of this application with a direction upon the learned Additional Sessions Judge in the Court below to dispose of Criminal Revision no. 27 of 2026 within a period of two weeks from the date of communication of this order after hearing the opposite parties. The petitioners undertake to make necessary communication in this regard to the opposite parties.
The learned Additional Sessions Judge shall decide the revisional application without being influenced by any observations made in this regard.
With the above observations, CRR 2388 of 2026 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
