Learned advocate appearing for the petitioner submits that the private respondents are trying to grab the property of the petitioner and with that end in view they are not only raising obstruction but also abusing the petitioner by hurling derogatory languages. Additionally, it has been submitted that the petitioner approached the learned Executive Magistrate under section 163(2) of the BNSS. However, the adamant and aggressive nature of the private respondents could not be controlled by the police authorities as the same is

with an illegal design of grabbing the property of the petitioner.

Learned advocate appearing for the State has submitted a report. Report reflects that earlier Kaliachak PS Case No. 1159/2024 dated 26.07.2025 was registered for investigation and on conclusion of investigation charge sheet has been submitted before the jurisdictional Court. Subsequently, again Kaliachak PS Case No. 1174/2024 dated 29.07.2024 was registered for investigation which was on the written complaint of the present petitioner. Charge sheet has also been submitted in connection with the said case, so far as the present information which has been furnished on 25.02.2025.

Police authorities have drawn up proceedings under section 126 of the BNSS. Having regard to the fact that the petitioner and the private respondents are known to each other and there is a long standing property dispute existing amongst them, police authorities would in the circumstances continue their surveillance and ensure that no untoward incident takes place because of the inimical relationship.

However, so far as the establishment of right, title and interest is concerned, if there is any

dispute, petitioner would approach the civil court for appropriate remedies.

With the aforesaid observations WPA 12703 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.
