....For the Respondent Nos.1 to 3 On the prayer of Mr. Baidurya Ghosal, learned counsel the affidavit filed in Court today, is taken on record. Copy has been served upon Mr. Indranath Mitra, learned advocate for the petitioners.
The principal prayer from the writ petition is quoted below :
"(a) A writ of and/or in the nature of mandamus commanding the respondents each one of them, their agents and/or assigns more particularly, Chairman, West Bengal Gramin Bank to consider the prayer for appointment on compassionate ground under died-in-harness category in favour of petitioner no.2, forthwith." Mr. Indranath Mitra, learned counsel appearing for the petitioners submits that, the issue is long pending. Referring to page 28 from the writ petition Mr. Baidurya Ghosal, learned counsel appearing for the respondent nos. 1 to 3 submits that, the same is the prescribed form. Since the petitioners have not applied
through the prescribed form, the claim of the petitioners has not been considered.
In view of the above, the petitioners shall be at liberty to submit their application through the said prescribed form forthwith.
After submission of the said prescribed form and receiving the same, the respondents through its appropriate authority shall consider the same strictly in accordance with law and inform the reasoned decision to the petitioners.
The entire exercise shall be carried out and completed by the appropriate authority of the respondents positively within a period of two months from the date of submission of the prescribed form. In the event any clarification is required by the authority, the petitioners shall be informed and the petitioners shall furnish the same to the authority. It is made clear that, this Court has not gone into the merits of the rival claims of the parties and the authority shall take its decision strictly in accordance with law.
In the event the reasoned decision goes in favour of the petitioners, the appropriate authority of the respondents shall give an immediate effect thereto in accordance with law but positively within a period of next four weeks from the date of the said reasoned decision to be taken.
With the above observations and directions, this writ petition, WPA 12722 of 2025 stands disposed of, without any order as to costs.
