Sl. No.1.

W.P.A. 10717 of 2015 With CPAN 404 of 2020 CAN 1 of 2020 CAN 5480 of 2020 Debdas Saha Vs.

Subrata Gupta & Ors.

(Via Video Conference) Mr. Arunava Ghosh, Mr. Dwaipayan Sengupta, Mr. Ravi Kumar Debey.

.....for the petitioner.

Mr. T. M. Siddiqui, Mr. N. Chatterjee .....for Alleged Contemnor.

Mr. Dipankar Mandal, Mr. Abdul Aziz Mondal, ......for the Municipality.

This contempt petition has been filed against the alleged violation and contumacious action of the alleged contemnor nos.2 and 3, and non-compliance of my judgment and order dated 15th November, 2019 by not giving any service benefit as per my direction in the aforesaid judgment. I find that my order has not been complied though almost two years are going to be passed, neither the alleged contemnors have filed any appeal till date against the same. From the conduct of the alleged contemnors, it appears that there is a clear violation of my order but before initiating contempt proceeding against

alleged contemnor nos.2 and 3, I am inclined to give one opportunity to them on their own prayer seeking time for compliance of my aforesaid order.

Both Mr. Siddiqui and Mr. Mondal representing the alleged contemnor nos.2 and 3 are directed to file affidavit of compliance by 27th September, 2021.

Learned advocate for the petitioner is given liberty to correct the cause title by inserting the name of the present incumbent alleged contemnor nos.2 and 3.

List this matter on 27th September, 2021.
