Mr. Ayan Banerjee .....for the State It appears from the averments made in the writ petition that the petitioners are aggrieved by some construction work being carried on by the respondent nos.8&9. Queries have been made by the petitioners under the Right to Information Act with regard to alleged unauthorised construction by Singdha Dolai and Goutam Kumar Dolui. The same have not been answered by the authorities of Panchaberia Gram Panchayat. No queries have been made with regard to any construction by the respondent Nos.8 and 9.

A representation dated May 13, 2021 being Annexure P/4 to the writ petition has also been filed against some illegal construction allegedly being carried on by Singdha Dolai and Goutam Kumar Dolui etc. but there are no allegations against the respondent nos. 8&9. In this petition the Doluis have not been impleaded, instead the respondents Nos.8 and 9 have been impleaded.

Under such circumstance, this writ petition cannot be entertained. The submissions of the petitioners are contradictory and not based on any evidence. Such vague and baseless allegations cannot be entertained.

The writ petition is dismissed. There shall be no order as to costs. The petitioner may approach the authorities in future with better particulars and materials.
