CRM (A) 1978 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Hariharpara Police Station Case No.302 of 2023 dated 15.07.2023 under Sections 147/148/149/188/ 186/333/353/286/326/307 of the Indian Penal Code read with Sections 131/132/135A of the Representative of the People Act, 1951 read with Section 3/4 of the Explosive Substances Act, 1908, pending before the Court of the learned Additional District and Sessions Judge, Berhampore. And In the matter of : Abdul Rajjak Mondal @ Abdur Razzaque ...... Petitioner Mr. Sabyasachi Chatterjee Mr. Sayan Banerjee Mr. Badrul Karim Mr. Kiron Sk.

Mr. Sayed Hossain ... For the petitioner Mr. Bibhaswan Bhattacharya Mr. Sharequl Haque ... For the State 1.

The instant application has been filed with a prayer for anticipatory bail.

2.

Learned counsel appearing on behalf of the petitioner has submitted that earlier the anticipatory bail application filed on behalf of the petitioner was rejected by the Hon'ble Division Bench and now the petitioner has filed the instant application under changed circumstances i.e., granting of bail of coaccused by the learned Trial Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short, 'BNSS'). 3.

In opposition to that, learned counsel appearing on behalf of the State has submitted that there are several criminal

antecedents against the petitioner and he has also referred to the statement of witness recorded under Section 161 of the Code of Criminal Procedure (Section 180 of the BNSS) and other documents in the case diary.

4.

After careful perusal of the case diary, I do not find any reason to enlarge the accused petitioner on anticipatory bail. 5.

This application for anticipatory bail is, thus, rejected. 6.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 7.

Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
