2) It is submitted by learned advocate representing the petitioner that he participated in selection process for filling up post of Assistant Teacher in pure science for upper primary level of classes in Batikar Abhedananda Vidyapith (HS), Birbhum (hereinafter referred to as "said school"). According to petitioner, he stood first in the panel which was prepared for filling up post of Assistant Teacher in pure science but said panel was not approved by the District Inspector of Schools (SE), Birbhum. Prayer is made for issuance of mandamus giving direction upon respondent authorities to

approve the panel and give appointment to the petitioner being first empanelled candidate.

3) On behalf of said school authority and State respondents it is submitted that the panel which was prepared in 2023 was not approved by the District Inspector of Schools (SE), Birbhum and an order was passed on 8th December, 2023. Copy of the order dated 8th December, 2023 issued by the District Inspector of Schools (SE), Birbhum is placed before this Court and same is taken on record. Furthermore, it is submitted that petitioner's name did not feature at the first position in the panel in question. It is contended on behalf of the respondents that decision of the District Inspector of Schools (SE), Bibhum dated 8th December, 2023 was communicated to the petitioner vide letter dated 1st August, 2024 by the Secretary of said school.

4) In view of the aforesaid submissions made on behalf of the parties, it appears that petitioner was not the selected candidate for being appointed as Assistant Teacher in pure science for upper primary level of classes in said school. Moreover, panel which was prepared in 2023 was not approved by the District Inspector of Schools (SE), Birbhum and an order was passed on 8th December, 2023 which is not under challenge in this writ petition.

5) In view of aforesaid scenario, no relief can be granted to the petitioner.

6) Writ petition stands dismissed.

7) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
