1. We have heard the learned counsel appearing for the parties.

2. In view of the dying declaration of the victim directly implicating the petitioner, we are not inclined to exercise our discretion under Section 438 Cr.P.C in favour of the present petitioner.

3. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.

4. CRM (A) 1735 of 2024 is accordingly, disposed of.
