The petitioner is in custody for about nine months and prays for bail.

Learned counsel for the petitioner submits that the petitioner was not involved in the alleged incident and only tried to save the victim. Though he has been named in the FIR, none of the witnesses has connected him to the alleged offence. Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner appears to be a part of the crowd which attacked the victim. No specific role has been attributed to the petitioner by the witnesses.

Considering the extent of complicity of the petitioner in the alleged crime, prayer for bail is allowed.

The petitioner namely Baban Singh be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Hooghly

subject to the condition that he shall appear before the learned trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. In the event the petitioner fails to appear before the learned trial Court on any date without any justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

The application for bail is disposed of.
