The allegation made in this writ petition is with regard to an unauthorised construction at Premises No.74, Prince Rahimuddin Lane, Ward No.89 of the Kolkata Municipal Corporation, P.S. Charu Market, Kolkata-700033. The competent authorities of the Kolkata Municipal Corporation have submitted a report prepared on September 6, 2021 from which it appears that steps have already been taken by the Corporation and a hearing had been called by the Special Officer (Bldg.), KMC on September 13, 2021. As it is submitted by the Kolkata Municipal Corporation that proceedings under Section 400(1) of the Kolkata Municipal Corporation Act, 1980 has been initiated, nothing further is required to be decided by this Court. The hearing

officer is already in seisin of the matter. The competent authority shall conclude the proceedings in accordance with law, as directed earlier by this Court and reach the same to its logical conclusion within the period fixed by this court. This writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
