1. Heard learned Counsel for the parties.

2. The petitioner is the person who is alleged to have physical relationship with the victim, impregnated her and induced miscarriage by giving medicine. The fact of miscarriage, however, is not supported by the medical opinion.

3. It is fairly submitted at the Bar that the victim is 39 years old with a son of 21 years old and the petitioner is 35 years old, whose status is unmarried. The petitioner had earlier filed a report before the Officer-in-Charge, Anandpur P.S. on July 2, 2022 to the effect that having entered into relationship with her, the victim has taken from him Rs. 4.5 lakhs approximately and she is continuously harassing him by blackmailing.

4. It is submitted by learned Counsel for the petitioner that the aforesaid FIR ended up in a G.D. entry only. The investigation is stated to have progressed substantially.

5. Considered the materials placed by learned Counsel for the parties including the statement of the witnesses.

6. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, circumstances involved, consensual relationship between the petitioner and the victim and the substantial progress in the investigation, it is directed that the petitioner shall be released on bail in the event of his arrest by the Arresting Officer on such terms and conditions as deemed just and proper in the facts and circumstances of the case in Connection with Anandpur Police Station Case No. 84 of 2023 dated 03.04.2023 including the condition that the petitioner shall not threaten, induce or coerce the victim in any manner whatsoever during the currency of the order.

7. Within three weeks of the receipt of server copy or certified copy of this order, the petitioner is directed to appear before the I.O along with a copy of this order.

8. Accordingly, the prayer for the anticipatory bail is allowed.
