The present revisional application was preferred challenging the continuation of the proceedings of Case No.C-36 of 2011 under Sections 420/406/120B of the Indian Penal Code as also the order dated 5.4.2012 passed by the learned Judicial Magistrate, 1st Court, Barrackpore.

Records of the revisional application reflect that the interim order was lastly extended on 8.5.2013 for a period of six weeks after the Summer vacation of the said year. Subsequently, the said interim order has never been extended. Having regard to the fact that more than eight years have passed and the contentions so advanced by the petitioner relate to issue of facts, this Court is of the opinion that the same cannot be adjudicated by this Court at this stage.

Accordingly, the revisional application being CRR 1862 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
