Learned advocate appearing for the petitioner submits that the petitioner has unnecessarily been detained in custody and he has been arrested on 21.08.24 i.e. more than 1 year 3 months is in custody. As such, on any stringent conditions, he may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that commercial quantity was seized from the petitioner, charges have already been framed in the case and the evidence of the case is to commence from the next schedule so fixed before the learned special court.

Having considered that the provision of Section 37 of the NDPS Act is attracted in the present case, I am of the opinion that this is not a fit case for granting bail.

Accordingly, CRM(NDPS) 689 of 2025 is dismissed. State would take steps for expediting the process of trial. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
