The petitioner has filed the writ application challenging the action of the authorities wherein the electric department has provided electric connection to the respondent no.4 without the consent of the writ petitioner.
Learned Counsel for the petitioner submits that he will be satisfied if the writ petition is disposed of by directing the concerned authority particularly the respondent no.2 to consider the representation filed by the writ petitioner.
Per contra, Learned Counsel for the respondent authorities submits that the petitioner has affirmed an Affidavit wherein he has given the consent for providing electric connection to the private respondent and accordingly, the respondents has provided electric connection to the private respondent.
The respondent authorities have produced a copy of the Affidavit dated 2nd August, 2022 affirmed
before the Notary Public wherein the petitioner has consented for providing electricity connection to the private respondent.
Learned Counsel for the petitioner denied the signature appearing in the Affidavit.
In view of the submissions made by Learned Counsel for the respective parties, this Court finds that no purpose will be served by keeping the writ petition pending.
Accordingly, the writ petition is disposed of by directing the respondent authorities particularly the respondent no.2 to consider the representation submitted by the writ petitioner dated 31st October, 2022 appearing at Annexure P-2 to the instant writ petition within eight weeks from the date of receipt of a copy of this order.
The Respondent no.2 is directed to communicate the decision taken by the authority to the petitioner within a week thereafter.
WPA 12846 of 2023 is disposed of.
