The allegation is that the petitioner murdered the victim by inflicting injury on him with a sharp cutting weapon. This is prima facie corroborated by the post mortem report. The petitioner says that the complaint is false. He has been framed due to political rivalry.

We have seen the statements of eyewitnesses in the case diary. At least two of such witnesses say that the petitioner was the assailant.

Considering the nature and gravity of the charge and the prima facie involvement of the petitioner in the alleged offence, although charge sheet has been submitted, we are not inclined to allow the petitioner's prayer for anticipatory bail. We also note that seven out of nine accused persons are absconding. The prayer for anticipatory bail is rejected. CRM No. 5641 of 2021 is, thus, dismissed.
