Learned counsel for the petitioner Mr. Phiroze Edulji fairly submits that he has come to know that FRT in the from of mistake of facts has been filed in respect of the said FIR.

This Court is of the view that remedy of the petitioner is under Section 173(8) of the Code of Criminal Procedure.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
