C.R.M. (M) 665 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Chinsurah Police Station Case No. 183 of 2019 dated 12.07.2019 under Sections 341/326/307 with added Sections 302 of the Indian Penal Code. And In Re : Ajoy Mondal @ Ajay Mondal Ms. S. Mitra ... For the Petitioner.
Mr. Avishek Sinha Ms. Sreetama Das ... For the State Report submitted by the State is taken on record. The petitioner renews his prayer for bail primarily on the ground that despite direction of this Court for expeditious disposal of the case within a specified time frame, trial is yet to be concluded.
Learned counsel for the State submits that the prosecution proposes to examine three more witnesses and schedule for their examination has been fixed on 2nd August, 2025, 5th August, 2025 and 6th August, 2025.
On merits, the petitioner does not deserve a favourable order. With regard to the stage of trial, since three more witnesses are liable to be examined by the prosecution, it is expected that trial shall be concluded within a reasonable time. Accordingly, the prayer for bail is rejected at this stage. Learned trial Court is directed to expedite the trial and ensure completion of the same within a reasonable time, without granting any unnecessary adjournment to either of the parties.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
