Heard the learned Advocates appearing for the parties. This is the second application under Section 438 of the Code of Criminal Procedure. The first application was rejected by a Bench of which one of us (Gangopadhyay, J.) I was a Member as has been submitted by the learned Advocate for the State. It was dismissed on 31st August, 2018. There is no change of circumstances due to any subsequent event.

Hence, the application is rejected.
