The petitioner applied as 'OBC'

category candidate in the recruitment process of the year 2009 with the DPSC, North 24-Parganas. He subsequently changed his candidature to that of 'General' succeeded and was empanelled. His result, however, withheld on the ground of verification of documents.

It appears that the petitioner's status continued to be questioned by the respondents despite accepting him as a 'General' category candidate and empanelling as such. Having once treated the petitioner as a general category candidate the respondents cannot now question the petitioner's candidature.

In these circumstances, the DPSC, North 24Parganas is directed to issue a letter of appointment to the petitioner as a 'General' category candidate with effect from 19th May, 2023 (date of filing of the writ petition) within a period of four weeks from the date of

receipt of a copy of this order. All service benefits shall be applied to the petitioner with effect from 19th May, 2023.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
