The instant revisional application has been preferred against order No. 53 dated 30.04.2011 passed by the learned Additional District & Sessions Judge, Fast Track Court, 3rd Court, Diamond Harbour, South 24-Parganas states as follows: "Accused Sanjoy Halder is produced from J.C.

the Court is lying vacant. Though the P.O. in-charge is engaged in judicial and administrative work of her own court one petition filed on behalf of the accused for hearing of argument and passing order for speedy disposal is considered by it. The original certified copy of order dated 03.11.2010 in C.R.C. No. 15647/10 is filed wherefrom it appears that the Hon'ble Court has been pleased to observe that it will be open to the petitioner/accused to apply for the transfer of the proceedings to another court. Now as the F.T.C.-II is in-charge of Ld. court of F.T.C.-III considering the long detention of the accused behind the bar and that the Hon'ble Court has already opined to transfer the case to any other court, in order to avoid further delay the P.O. in-

charge decides to hear the argument and dispose of the case. So fix 14.06.11 for argument.

Considered the contentions of the petitioner as well as impugned order. The impugned order does not suffer from any illegality or impropriety and as such this court is not inclined to interfere with the same.

Accordingly, the instant revisional application is dismissed. Copy of the order be sent to the Department as well as learned Trial Court for due compliance.
