(A) 2145 of 2023 In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Balurghat P.S. Case No. 502 of 2017 dated 03.12.2017 under Sections 21(c)/22(c)/23(c)/25/27A of the NDPS Act.

And In the matter of: Pradeep Sarkar @ Pradip Kumar Sarkar @ Pradip Sarkheer ....Petitioner Mr. Sayan De Mr. Sayan Kanjilal Mr. Kaustuv Shome ...for the Petitioner Mr. Rudradipta Nandy Mr. Ashok Das ...for the State Mr. De, learned advocate for the petitioner intends to not to press the application for anticipatory bail as he was not instructed as to whether proclamation and attachment has been issued or not against the petitioner in connection with the instant application.

Mr. Nandy, learned advocate on behalf of the State opposes such contention.

However, having regard to the prayer advanced by the learned advocate for the petitioner, CRM (A) 2145 of 2023 is dismissed as not pressed with liberty to file afresh, if there is change of circumstances.
