It is the case of the petitioner that though he has deposited the course fees in due time, the college has failed to forward his name to the university to allow him to appear in the 6th Semester examination scheduled to be held on and from June 1, 2023. The college submits that the petitioner has not deposited the fees within the deadline prescribed by the college.

Mr. Majumder, learned advocate representing the university, on the other hand submits that in the documents forwarded by the college pertaining to the class assessments of the petitioner, the petitioner's signatures differ from each other and it raises a serious doubt about the bona fide of the writ petitioner. Since the petitioner has been allowed by the university to appear in all the previous examinations, I am not inclined to accept the contention of the university at this stage when the petitioner is going to take his final semester examination. It is also admitted that the petitioner has deposited the required fees with the college.

The writ petition is disposed of with a direction upon the university to issue the admit card to the petitioner by May 31, 2023 to enable him to appear in the final semester examination.

However, the university will be at liberty to take appropriate steps against the petitioner or against the college if it is found that the petitioner is not a bona fide student of the college.

Accordingly, WPA 12868 of 2023 is disposed of. (Kausik Chanda, J.)
