Public Prosecutor Mr. Bibaswan Bhattacharya ... ... for the State It is submitted on behalf of the petitioner that he is in custody for more than three years and four months. It is further submitted that there is slow progress in the trial of the case. Learned advocate appearing for the State opposes the prayer for bail and submits that eyewitnesses implicated the petitioner in the murder of the deceased.

In view of the gravity of the offence and prima facie involvement of the petitioner in the alleged crime, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is thus rejected.

We however, direct the trial court to proceed with the trial with utmost expedition and conclude the same at an early date preferably within one year from the next date fixed for recording of evidence without granting unnecessary adjournment to either of the parties.
