1. Affidavit of service filed on behalf of the petitioner in Court today is taken on record.

2. None represents the respondents despite service of notice.

3 This instant writ petition has been filed by the petitioner seeking direction upon the respondent nos. 2 to 4 to refund the earnest money deposited by the petitioner at the time of auction sale, by way of Pay Order No. 140147 dated 28.05.2013 drawn on Axis Bank, Dalhousie, along with 18% interest. 4.

It is the specific case of the petitioner, that as per notification dated 30th April, 2013, he participated in the e-auction sale and deposited earnest money as aforesaid. Thereafter, no auction sale has been effected by the bank authority, although the petitioner has deposited Rs.

6,00,000/- and is ready to purchase the property in question.

5. He also approached the authority by way of filing an application under Section 6 of the RTI Act,

2005 to ascertain the reason of not effecting sale in his favour.

6. He filed the first appeal as well as the second appeal under Section 19 of the RTI Act, but all are in vain.

7. He also made a representation dated 27th March, 2025, stating all the facts and seeking refund of earnest money with interest within 7 days, but got no result. Ultimately, he was compelled to file this application against the bank authority.

The said representation is also under consideration of the respondent and not yet disposed of.

In the above backdrop, no useful purpose would be served in keeping this application pending.

10. Consequently, the respondent no. 3 is directed to consider the representation dated 27th March, 2025, after affording an opportunity of hearing to the petitioner within 6 weeks from the date of communication of this copy of this order and pass a reasoned order.

Let a copy of the reasoned order be also communicated to the petitioner within one week thereafter.

Since no affidavit has been called for, all allegations made against the respondents by the petitioner are deemed not to have been admitted. 8.

With the above observations, WPA 12690 of 2025 is disposed of.

There shall be no order as to costs.

10. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
