Public Prosecutor Mr. Subrato Roy ... for the State It is submitted on behalf of the petitioner that he is in custody for about one year and seven months. It is further submitted there is delay in trial. Accordingly, he prays for bail.

Learned Additional Public Prosecutor opposes the prayer for bail and submits delay is at the behest of co-accused who has approached this court and has obtained an order of stay. We have considered the materials on record. Allegations are grave. Petitioner personated as a doctor and treated patients. Delay in the matter is not at the behest of the prosecution. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is thus rejected.
