07.06.2023 sdas rejected C.R.M.(DB) No. 2133 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Madhyamgram Police Station Case No. 525 of 2022 dated 23.10.2022 under Sections 302/201/34 of the Indian Penal Code.
And In Re : Md. Tipu alias Tipu & Anr. .... petitioners Mr. Angshuman Chakraborty ....for the petitioners Mr. Arijit Ganguly Ms. Puspita Saha .... for the State Learned Counsel for the petitioners submits there is no direct evidence connecting them with the murder. They have been implicated out of suspicion.
Learned Counsel for the State opposes the prayer for bail.
We have considered the materials on record. Petitioners made extra-judicial confession before local villagers. Petitioner no. 2 had motive to commit the crime. Keeping in mind the aforesaid incriminating materials and gravity of the offence, we are not inclined to grant bail to the petitioners at this stage. The application for bail is, thus, rejected.
