The grievance of the petitioner pertains to non-payment of compensation under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. It is alleged on behalf of the petitioner that the land has been acquired in terms of a General Notice dated May 10, 2012 published by the Railway Authorities.

On behalf of the Railway Authorities it is submitted that the intended project by the Railways had been abandoned as far back as on 2014 and the alleged acquisition was never given any effect to. It is further submitted on behalf of the Railway Authorities that the petitioner is still in possession of the subject land. In view of the above, there is no question of payment of any compensation.

In view of the submissions made on behalf of the Railway Authorities that the impugned acquisition had never seen the light of the day and the land of the petitioner was never acquired, there is no question of any payment of compensation to the petitioner.

In such circumstances, WPA No. 13970 of 2024 stands dismissed.

However, there shall be no order as to costs.
