Mr. Angshuman Chakraborty, learned Advocate appearing for the petitioners submits that the petitioners are in custody for about two years and four months, as such on any stringent condition the petitioners may be released on bail as till date trial has not commenced.

Mr. Swapan Banerjee, learned Advocate appearing for the State produces the case diary and has drawn the attention of the Court to the statement recorded under Section 164 of the Code of Criminal Procedure, 1973 of the daughter of the deceased. We have considered the manner in which the injury was inflicted upon the deceased and the complicity of the petitioners in respect of the injury inflicted.

Having considered the same, we are not inclined to release the petitioners on bail at this stage.

Accordingly, the application for bail being CRM (DB) 2147 of 2023 is rejected.
