This revisional application was preferred challenging the charge-sheet filed in connection with Howrah Police Station Case No. 279 of 2020 dated 22.09.2020 under Sections 498A/406 of the Indian Penal Code. At the time when this revisional application was admitted, it was submitted that the parties have amicably settled their disputes and a reference was made to a "Memorandum of Understanding/Settlement/Consent Term", as is reflected in the order dated 02.09.2021 passed by a co-ordinate Bench of this Court.
Mr. Das, learned advocate appearing for the State submits that he has received no instructions regarding such compromise being effected as charge-sheet was earlier filed by the police authorities.
Having considered that there has been no persuasion on behalf of the petitioners before this Court, I am of the view that unnecessarily the revisional application should not be kept pending. The petitioners would be at liberty to approach with the terms before the jurisdictional court and the
jurisdictional court will exercise its powers, if such terms be placed before it in accordance with the provisions of law. With the aforesaid observations, the revisional application being CRR 1698 of 2021 is disposed of. Pending connected applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
