Learned advocate appearing for the petitioner submits that the petitioner was arrested on 13th October, 2022 and since then he is in custody. Learned advocate appearing for the petitioner submits that at the spur of moment the incident occurred and as such further detention of the petitioner, after charge-sheet being submitted is unwarranted.

Mr. Nandy, learned advocate appearing for the State has produced the case diary as also the earlier orders passed in the month of February and March, 2023 by a co-ordinate Bench and we find that the prayer for bail of the similarly circumstanced accused persons have been rejected. Therefore, we are not inclined to allow the prayer for bail of the petitioner. The application for bail being CRM 2157 of 2023 is dismissed.
