1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the local Area Secretary of the erstwhile ruling political party.

Immediately after the election, the present FIR was lodged stating that the petitioner and others had attacked and assaulted the supporters of the other political party. The petitioner was not present there at the time of occurrence. He has been falsely implicated in this case.

2. Learned counsel appearing for the State relies on the case diary and opposes the prayer for anticipatory bail. She refers to the medical report, which shows fracture injury on elbow, amongst other things. She relies on the other injury report as well as the statements of witnesses including the victim, which specifically implicate the petitioner.

3. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.

5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
