In this public interest petition there is allegation of defalcation of funds under the MGNREGA while implementing the projects in Golap Ganj Gram Panchayat.
Submission of learned counsel for the petitioners is that the various projects relating to construction of cow sheds, excavation of ponds and re-excavation of canals, though shown to be completed have not been completed and the defalcation of funds has been done. This submission has been denied by the learned counsel for the respondent nos.7 and 8.
The record reflects that the petitioners have already made the representation dated 14.06.2022 to the respondent no.3 i.e. District Magistrate and Collector, Malda raising the above grievance. The grievance raised by the petitioners needs factual enquiry, which can more appropriately be done by the respondent no.3.
Hence, we dispose of the present petition directing the respondent no.3 to duly consider and decide the petitioners'
representation dated 14.06.2022 in accordance with law after giving an opportunity of hearing to all the concerned parties.
Let this exercise be completed within a period three months from the date of receipt of this order. The petition is accordingly disposed of.
