Petitioner is aggrieved by the fact that the private respondents have been threatening the petitioner and has, by way of illegal means, broken the padlock and trespassed into the property. Consequent to the information so furnished, Rampurhat P.S.

Case No.182 of dated 19.04.2025 has been registered for investigation. Learned advocate for the private respondent no.5 submits that he has already received a notice under Section 35(3) of the BNSS.

State has submitted a report.

However, the learned advocate for the petitioner presently prays that the petitioner intends to take possession of certain articles which have been there at the premises.

Be that as it may, since the petitioner has prayed for effective investigation and for the articles which have been kept at the residence, petitioner be well advised to approach the jurisdictional Magistrate in seisin of Rampurhat P.S. Case No.182 of 2025. If an application for entering the premises for taking out certain articles which the petitioner has left behind, is made before the learned Magistrate, learned Magistrate would in the circumstances after calling for a police report pass necessary directions preferably within a period of 15 days from the date of filing of such application.

With the aforesaid observations, WPA 13111 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
