12. 07 . 2022 CRR 2162 of 2022 BP Sl.158 Court no.42.
In re: An application under Section 482 read with Section 401 of the Code of Criminal Procedure, 1973.
In the matter of: Lalon Sk.
...petitioner Ms. Minati Gomes ...for the petitioner.
The instant criminal revision has been filed by the petitioner praying for quashing of the order dated 26th June, 2019 in Execution Case No. 827 of 2019 arising out of M.R. Case No. 170 of 2019 under Section 125 of the Code of Criminal Procedure. Initially execution case was filed in the year 2019 by the opposite party no.2 for maintenance allowance for four months @ Rs. 1,500/- per month, total being Rs. 6,000/-. Then subsequent execution petition was filed and entertained by the trial court in the same execution case. Subsequently the impugned order was passed. It is not in dispute in the order passed in M.R. Case 170 of 2019 has reached its
finality. The petitioner has not preferred any appeal against the said order under Section 125 of the Code of Criminal Procedure.
In view of such circumstances, I find no merit in the instant revision. Accordingly, the criminal revision is summarily dismissed.
