08.06.2023 sdas rejected C.R.M.(DB) No. 2168 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Mothabari Police Station Case No. 84 of 2022 dated 02.03.2022 under Sections 498A/326/307/120B of the Indian Penal Code adding Section 302 of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibitions Act and subsequently charge-sheeted under Sections 498A/326/307/304B/302/34 of the Indian Penal Code and Section 4 of the Dowry Prohibitions Act.

And In Re : Pintu Mandal .... petitioner Mr. Mrityunjoy Chatterjee Mr. Ravi Ranjan Kumar ....for the petitioner Mr. A. Ganguly Mr. P. K. Ganguly .... for the State Heard the learned Counsels for the parties.

We have considered the materials on record. Dying declaration of the victim implicates the petitioner in the murder. Bail prayer of the petitioner was rejected earlier in February, 2023. Thereafter case has been committed to the Court of Sessions. Under such circumstances, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
