Learned advocate appearing for the petitioner complains that the private respondents have been attempting to grab the property of the petitioner and with that end in view has been threatening of dire consequences. To that effect, information was furnished not only to the local police station, but also to the superior officers of police.

So far as the information furnished by the petitioner is concerned, learned advocate appearing for the State has submitted a report which reflects that the police authorities have drawn up proceedings against the private respondent nos. 4 to 7 under Section 351(2) of BNS vide Kakdwip PS N.C.R. No. 294/2025 dated 23.06.2025.

Having considered that steps have been taken by the police authorities for the alleged offence being committed, if the petitioner is aggrieved in respect of the fact that a noncognizable offence has been the genesis of the case, petitioner would approach the jurisdictional Magistrate for ventilating his grievance. In view of the steps so taken by the police authorities, I am of the view that police authorities would continue to keep their surveillance and ensure that no untoward incident results because of the inimical relationship existing between the petitioner and the private respondents.

With the aforesaid observations, the writ petition being WPA 12891 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
