Mr. Suman Banerjee ..For the Petitioner Mr. Sujit Sankar Koley ...for the DPL This is an application for correction of the order dated September 7, 2021. In the third sentence of the first page, it is recorded that the petitioner retired from service on March 31, 2015 and was paid the amount on account of leave salary and gratuity aggregating to Rs.10,66,969/- on September 30, 2015. On the basis of the submission made by the petitioner this recording was made and interest on Rs.10,66,969/- @ 6% p.a. was allowed for the period between April 1, 2015 and September 30, 2015. It is now submitted by the petitioner that the petitioner had retired on September 30, 2015 and was paid the said amount on September 28, 2016. Interest should be calculated for this period. On behalf of the respondent, it has been fairly submitted that the dates in the order have gone down wrongly due to wrong dates

having been furnished to the Court. The correct dates are now provided.

On behalf of the respondent, it is submitted that the figure of aggregating amount is wrong and the correct figure is Rs.10,66,368/- instead of Rs.10,66,969/-.

This submission cannot be accepted as the records of the respondent no. 1 already before this Court speaks otherwise. Be that as it may, I direct the respondent no. 1 to pay interest to the petitioner @ 6% p.a. on Rs.10,66,969/- for the period between October 1, 2015 till September 28, 2016 within a period of six weeks from the date of the communication of this order. Nothing further remains to be adjudicated.

The application being CAN 1 of 2022 is accordingly disposed of.
