The petitioner renews his prayer for bail. Earlier, the prayer of this petitioner and a co-accused person was rejected by a Coordinate Bench by an order dated September 14, 2023, passed in CRM (DB) 3567 of 2023.

The charge is of robbery. It is alleged that the accused persons had robbed the victim by administering on him stupefying substance.

The petitioner denies the allegations. He says that his earlier bail prayer was rejected because that had been made at a very early stage. He has no criminal antecedents. He is in custody for 393 days. Charge has not yet been framed. Nobody can say when the trial will conclude. He prays for bail. Signed By :

Learned Advocate for the State opposes the prayer for bail. Learned Advocate says that charge could not be framed because the petitioner is not represented before the learned Trial Court. We do not find that to be a very acceptable explanation. We are disturbed by the delay in considering the charges. However, given the gravity of the alleged offence and the quality of material that is available in the case diary, we are not inclined to enlarge the petitioner on bail, at this stage. The prayer for bail is, accordingly, rejected. CRM (DB) 1586 of 2024 is dismissed.

The petitioner has been in custody for a long period of time. The learned Trial Court shall immediately address the issue of consideration of the charges and shall spare no efforts to expedite the trial and bring the same to its logical conclusion as early as possible.
