Case No. 402/2023 dated 31.03.2023 under Sections 188/307/353/34 of the Indian Penal Code and Sections 21(C)/29 of the NDPS Act and Sections 25/27 of the Arms Act.

We have perused the materials appearing in the case diary as well as the report submitted by Mr. Nandy, learned Advocate appearing for the State. It reflects that the petitioner is a history-sheeter and there are number of narcotic cases against him.

Mere non-recovery may not be sufficient in the present case for favouring the petitioner with an order of anticipatory bail.

Accordingly, the prayer for anticipatory bail is rejected. The petitioner is directed to approach the regular Court for bail. The application for anticipatory bail being C.R.M. (A) 2171 of 2023 is dismissed.
