Vs.

The State of West Bengal & ors.

Mr. Partha Sarathi Bhattacharyya, Sr. Advocate Sk. Musior Rahman, Mr. Mrinal Kanti Sardar, Mr. Raju Bhattacharyya ...for the petitioners Mr. Tapan Kr. Mukherjee, Sr. Advoate & Ld. AGP Ms. Tuli Sinha ...for the State Mr. Bhagbat Chaudhuri, M. A. Zinna ...for the added respondent An order dated August 3, 2011 passed in O.A.2244 of 2008 is under challenge in the present writ petition.

The writ petition was filed on May 9, 2012.

An interim order in such writ petition staying the operation of the impugned order of the Tribunal was granted on May 18, 2012 which was extended from time to time.

Learned Senior Advocate appearing for the State submits that, the authorities recasted the panel in terms of the order of the learned Tribunal on April 13, 2012.

On April 13, 2012, there was no stay order by the High Court. In fact, the writ petitioners were yet to approach the High Court.

A period of 12 years elapsed from the date of the impugned order of the Tribunal. The Court is informed that, writ petitioners are working.

There is no other challenge to the selection process.

Since, there is no other challenge, and since writ petitioners are also working, it would be inappropriate to disturb the situation prevailing. In such circumstances, we dispose of W.P.S.T. 159 of 2012 without any order as to costs. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
