Heard learned counsels for the parties.

The grievance of the petitioner is that his application for grant of permit in the route Polerhat to Shyambazar was accepted by the respondents but his offer for depositing requisite fees was not accepted.

The innocuous prayer of the petitioner is for acceptance of the requisite fees by the authority for issuance of permit in his favour.

Learned counsel for the respondents submits that the 4th respondent be directed to accept such fees to be deposited by the petitioner within two weeks from date. In view of the above, the writ petition is disposed of directing the 4th respondent to accept the prescribed fees to be deposited by the petitioner within two weeks from date.

Upon the application along with the prescribed fees being sent to the 2nd respondent within a week thereafter by the 4th respondent, the 2nd respondent shall consider the application so filed by the petitioner for issuance of permit and dispose of the same within eight weeks thereafter after affording reasonable opportunity of hearing to the petitioner, in accordance with law. With the above observations and directions this writ petition being WPA 12912 of 2023 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
