Petitioner is aggrieved by the fact that the private respondent is carrying on business of Raw Leather Processing Unit which is spreading a stinking smell, thereby affecting the food business which has been carried out by him.

Petitioner approached the executive Magistrate, consequent to the same for violation, police authorities have registered Nowda PS Case No. 134 of 2024 dated 21.05.2024 under the relevant provisions of law. Consequently charge sheet has also been filed in connection with the said case.

Having considered the plight expressed by the petitioner, I grant liberty to the petitioner to approach the Municipal/Panchayat authorities responsible for granting license, if any, and/or under

the appropriate authorities of the West Bengal Pollution Control Board.

If the authorities find there are violations of law, they would take steps by informing the police authorities on receipt of such report, who would implement the directions of both the statutory authorities.

With the aforesaid observations WPA 13997 of 2024 is disposed of.
