The Court is approached under Article 227 of the Constitution of India soliciting a direction to ensure expeditious disposal of Title Suit being T.S.229 of 2015 now pending before the learned Civil Judge (Junior Division), 2nd Court at Sealdah. Mr. Iftekar Munshi, learned Advocate representing the petitioner submits that it is a suit for eviction of licensee, instituted in the year 2015. The evidence has already been concluded, as adduced by both the parties to this case, on 15th February, 2021 and thereafter the suit was posted for argument on 25th March, 2021. It is further contended by the learned Advocate for the petitioner that even after fixing the date for argument, the matter is not being taken up resulting in unnecessary hardship and protraction, thereby adversely affecting the valuable rights of the petitioner/plaintiff. In such context, it is proposed that a direction is necessary directing

expeditious disposal of the pending suit.

In view of the nature of the order being proposed to be made and the issue requires to be addressed, the Court is of the view that extensive hearing is not necessary in this case, and the matter may even be disposed of without inviting presence of the opposite party/defendant.

Accordingly, the service upon the opposite party/defendant stands dispensed with.

Learned Civil Judge (Junior Division), 2nd Court, Sealdah is directed to dispose of the case expeditiously as possible after hearing the argument, to be advanced by either of the parties, without granting any unnecessary adjournments, preferably within April, 2022.

Petitioner is directed to communicate this order to the learned Court below as well as the opposite party/defendant and his learned Advocate appearing in the Court below.

With this observation and direction, the revisional application stands disposed of.

Urgent xerox certified copy of this order be given to the parties on usual undertaking.
