Petitioner is aggrieved by the fact that he apprehends that his business may be jeopardized at the behest of certain local miscreants and to that effect, information was furnished before the police authorities and yet no action has been taken. Report has been submitted by Mr. Banerjee, learned Additional Government Pleader.

Report reflects that the police authorities cross-checked from the petitioner himself but proper documentation nor any place of business could be shown by the petitioner. As such no issue relating to causing of disturbance to his business can arise.

Be that as it may, in case the petitioner is able to show proper licence relating to excavation of

mines or minerals or transport of any minerals, in that case, police authorities would on enquiry if it is found that the petitioner's business is disturbed, render appropriate assistance.

It is reiterated that the petitioner should be in a position to show licence for permission being granted by the appropriate authority for excavations of mines for minerals, coal or any product or any transportation in respect of the aforesaid products from the appropriate authority concerned. Then only police will render assistance, otherwise only on oral assertions police will not act.

With the aforesaid observations WPA 14077 of 2024 is disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
