The only prayer of the writ petitioner is for a direction on the respondent Bank namely, the Contai Co-operative Bank Limited, to consider the application for a one-time settlement made by the petitioner on 09.06.2022.

It appears from the documents on record that by an order dated 23.07.2019, a learned Single Judge of this Court gave liberty to the petitioner to approach the Bank for a settlement. This application was made in June, 2022.

Learned counsel appearing for the Bank submits that the SARFAESI proceedings have already been invoked in June, 2018.

WPA 12520 of 2022 is disposed of with a direction on the respondent Bank to consider the application of the petitioner for a one-time settlement and dispose of the same with a reasoned order to be made within four weeks from date. A copy of the reasoned order shall be made available to the petitioner within one week from the date on which such order is passed.

This court has not gone into the merits of the action taken under the SARFAESI Act.
