By an order dated August 1, 2023, this Court was of the view that the writ petition should be dismissed. The petitioner was accordingly directed to pay costs assessed at Rs.10,000/- to the State Legal Services Authority (SLSA) within a month from the date of the order. The writ petition was directed to appear as "To Be Mentioned" on September 11, 2023 showing necessary compliance of the Court's order. No one appeared on behalf of the petitioner on September 11, 2023.

Accordingly, the matter was again posted for consideration under the heading "To Be Mentioned" today (22.09.2023).

Today also the petitioner is not represented. Mr. Das, learned counsel appears on behalf of Eastern Coalfields Limited (ECL)/respondents

submits that no communication has been made to him intimating the payment of costs to SLSA.

Accordingly, the conduct of the petitioner is not at all appreciated by this Court.

This Court constrained to direct the District Magistrate, South 24-Parganas to take necessary steps in the matter for recovery of the said costs under the Bengal Public Demands Recovery Act, 1913 by following the appropriate procedure.

Such steps should be taken within one month from the date of this order.

Registry to serve a copy of this order upon the learned District Magistrate, South 24-Parganas. The learned District Magistrate shall intimate to the Registrar General, Appellate Side of this Court as to the steps taken by him for recovery of the aforesaid amount.

Let the matter appear for further consideration under the same heading "To Be Mentioned" in the combined monthly list of December, 2023.

All parties shall act on the server copies of this order duly downloaded from the official Website of this Hon'ble Court.
