The appeal is at the instance of the hirer. The hirer had purchased a vehicle but failed to pay regular EMI. The injunction order was passed subject to payment of regular EMI as agreed by the plaintiff.

In view of the fact, the plaintiff has failed to pay the EMI, we find that the Trial Court was justified in not granting extension of interim order of injunction. Moreover, it appears that the said petition might have been disposed of in the year 2016. In view thereof the appeal stands dismissed.

No order as to costs.
